Terms of Service

By accessing or using the MRKT Automotive LLC platform at mrktappraisal.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including consumers submitting vehicles for appraisal, registered garage users, and dealer partners.

MRKT Automotive LLC ("MRKT," "we," "us," or "our") provides professional collector and specialty vehicle appraisal services, including:

• AI-assisted and human-reviewed vehicle appraisal reports
• Certified appraisal documents for insurance, lending, estate, pre-sale, and fair market value purposes
• Comparable sales analysis and market data
• A consumer vehicle portfolio dashboard (MRKT Garage)
• A dealer acquisition portal for licensed dealer partners

All appraisals are conducted remotely based on owner-submitted vehicle information, photographs, and market data unless otherwise stated.

Appraisal reports generated by MRKT represent an opinion of value at the time of the appraisal based on submitted information and available market data. MRKT makes no guarantee of sale price, insurance payout, loan approval, or any financial outcome based on appraised values. Value conclusions are valid as of the effective date only. MRKT is not responsible for decisions made by third parties — including insurers, lenders, courts, estates, or buyers — based on appraisal reports.

The vehicle was not physically inspected unless otherwise explicitly stated in the report. No mechanical teardown was performed. Users are responsible for providing accurate and complete vehicle information. Submission of false, fraudulent, or misleading information voids the appraisal and may result in account termination without refund.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, complete, and current information. You must be at least 18 years old to use the Service. MRKT reserves the right to suspend or terminate accounts that violate these Terms.

Appraisal services are paid in advance via Stripe. All sales are final. Because appraisal reports are delivered digital services, no refunds are issued once the report has been delivered or the appraisal process has commenced. Dealer subscription fees are billed monthly and are non-refundable for the current billing period. You may cancel your dealer subscription at any time by contacting support@mrktappraisal.com; cancellation takes effect at the end of the current billing period.

All prices are in US dollars. Accepted payment methods include Visa, Mastercard, American Express, and Discover via Stripe. MRKT does not store payment card information — all payment processing is handled by Stripe, Inc.

Dealer portal subscriptions automatically renew monthly at the then-current rate unless cancelled. MRKT will notify you via email (support@mrktappraisal.com) of any material changes to subscription pricing at least 30 days in advance. Continued use of the dealer portal after a price change constitutes acceptance of the new pricing.

By submitting vehicle photographs, documents, videos, and other content ("Submissions") to MRKT, you grant MRKT a non-exclusive, royalty-free license to use, store, and process your Submissions solely for the purpose of providing the Service. You represent and warrant that you own or have the right to submit all Submissions, and that your Submissions are accurate to the best of your knowledge.

MRKT may use aggregated, anonymized submission data to improve its AI valuation models and market intelligence products. No personally identifiable information will be shared with third parties except as described in the Privacy Policy.

You agree not to:

• Submit false, fraudulent, or misleading vehicle information, photographs, or documentation
• Use appraisal reports for any purpose other than the stated intended use
• Reverse engineer, scrape, or attempt to extract data from the Service
• Use the Service to harass, defraud, or harm any third party
• Circumvent any security or access control measures
• Use the Service in any way that violates applicable law

All content, software, designs, trademarks, and intellectual property on the Service are owned by MRKT Automotive LLC. Appraisal reports are licensed to the purchasing user for the stated intended use only and may not be resold, redistributed, or used for commercial purposes without written consent from MRKT. The MRKT name, logo, and branding are trademarks of MRKT Automotive LLC.

The Service may contain links to third-party websites (including auction platforms such as Bring a Trailer, Cars & Bids, Mecum, Barrett-Jackson, PCarMarket, and Classic.com) as comparable sales evidence. These links are provided for informational purposes only. MRKT has no control over third-party sites and assumes no responsibility for their content, accuracy, or practices.

Dealer partners accessing the MRKT dealer portal agree to use submission data solely for the purpose of evaluating and making offers on submitted vehicles. Dealer partners may not use consumer submission data for any other commercial purpose, share it with unauthorized third parties, or retain it beyond the scope of an active offer or transaction. Consumer submissions are only visible to the dealer to whom they were submitted.

The Service uses AI-powered tools to assist in vehicle valuation. AI-generated valuations are reviewed by human appraisers on Certified and Expedited tier reports. AI-only tier reports are generated entirely by automated means and are labeled accordingly. Users who wish to opt out of AI-assisted processing may contact valuations@mrktappraisal.com to request manual review; additional fees may apply.

To the maximum extent permitted by law, MRKT's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by the user for the specific appraisal or service giving rise to the claim, or six (6) months of subscription fees for dealer partners.

MRKT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. MRKT does not warrant that the Service will be uninterrupted, error-free, or that appraisal values will be accepted by any insurer, lender, court, or buyer.

Any dispute arising out of or relating to these Terms or the Service shall first be submitted to informal negotiation for a period of 30 days. If unresolved, the dispute shall be submitted to binding arbitration in Michigan, United States, under the rules of the American Arbitration Association. MRKT will cover arbitration fees if they are deemed excessive. Court litigation, if necessary, shall take place in Michigan. You have one (1) year from the date a claim arises to bring action.

Nothing in this section prevents either party from seeking emergency injunctive relief in court to prevent irreparable harm.

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

MRKT reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The current Terms are always available at mrktappraisal.com/terms.
